These rights may be exercised in all media formats now known or hereinafter invented. This license is not transferable and or subject to sublicense, although You may inform others that the Work may be directly licensed by them at no charge from the Licensor. All rights not expressly granted herein are reserved to Licensor.

3. Restriction: Attribution Required. The license granted in Section 3 above is expressly made subject to and limited by the following restrictions. Unless Licensor, at Licensor’s sole discretion, requests in writing that You remove attribution (in which event, You must remove attribution immediately), then you must provide (by means reasonable to the medium) notice to all persons or entities receiving access to or copies of the Work (or adaptations, improvements or derivatives of the Work) through you of: (i) the original title of the Work as indicated in the Work,(ii) the author of the Work; and (iii) that the Work (or adaptation, improvement, or derivative, as applicable) is being distributed pursuant to a license posted at www.cushing.org/license-terms; In addition, any legal notices and disclaimers incorporated into the Work must be left intact and republished in all reproductions, adaptations, improvements or derivative. EXCEPT TO THE EXTENT REQUIRED BY APPLICABLE LAW, IN NO EVENT WILL LICENSOR BE LIABLE TO YOU ON ANY LEGAL THEORY FOR ANY SPECIAL, INCIDENTAL, CONSEQUENTIAL, PUNITIVE OR EXEMPLARY DAMAGES ARISING OUT OF THIS LICENSE OR THE USE OF THE WORK, EVEN IF LICENSOR HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

5. Termination. This agreement and the rights granted hereunder will terminate automatically upon any breach by You of the terms of this License. Individuals or entities who have received the Work, or adaptations, improvements, or derivatives of the Work from You may continue to use their copies of such materials so long as they do not remove notices and attribution required by this agreement from their copies of such materials. Sections 5 and 6 will survive any termination of this License.

6. Miscellaneous. If any provision of this agreement is invalid or unenforceable, it will not affect the validity or enforceability of the remainder of this agreement. No term or provision of this agreement will be deemed waived and no breach consented to unless such waiver or consent is set forth in a paper writing and signed by the party to be charged with such waiver or consent. This agreement constitutes the entire agreement between the parties with respect to the Work licensed here. There are no understandings, agreements or representations with respect to the Work not specified here. This Agreement may not be modified without the mutual written agreement of the Licensor and You. This agreement is governed by the laws of The Commonwealth of Massachusetts, without regard to its conflicts of laws principles, and You agree that all litigation arising from or relating to the Work or this agreement will be filed and prosecuted in any court of competent subject matter jurisdiction in Boston, MA, USA.
